Terms of Service

These Terms of Service ("Terms") govern your use of SafariLists ("Platform"), operated by SafariLists Ltd. By creating an account or using the Platform you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. Definitions

  • "Platform" — the SafariLists website and services at safarilists.com.
  • "Traveler" — a user who browses and inquires about safari packages.
  • "Operator" — a verified safari company or independent guide who lists packages.
  • "Listing" — a safari package, property, or volunteer opportunity published on the Platform.
  • "Booking" — a confirmed reservation between a Traveler and an Operator.

2. Eligibility

You must be at least 18 years old to use the Platform. By registering, you confirm that all information you provide is accurate, current, and complete. We reserve the right to suspend accounts where false information is detected.

3. Operator Obligations

Operators must:

  • Hold a valid tourism licence and all required permits for the jurisdictions in which they operate.
  • Provide accurate, up-to-date information in all Listings.
  • Respond to Traveler inquiries within 60 minutes during business hours (Premium and Enterprise plans).
  • Deliver the services as described in the Listing at the agreed price.
  • Maintain adequate liability insurance.
  • Not list packages that involve illegal activities or harm to wildlife or people.

4. Traveler Obligations

Travelers must:

  • Provide accurate information when submitting inquiries and making bookings.
  • Pay all agreed amounts on time.
  • Comply with the Operator's health, safety, and conduct policies during trips.
  • Only leave reviews for trips they have actually completed.

5. Payments & Escrow

All payments are processed through our escrow system. Funds are held securely and released to the Operator on your travel start date. You have a 72-hour dispute window after your departure date to raise a complaint before funds are released.

SafariLists charges a platform fee on each completed booking. This fee is included in the listed price — Operators do not charge additional platform fees to Travelers.

Refunds are governed by the Operator's stated cancellation policy. In the event of Operator cancellation, you are entitled to a full refund of all amounts paid.

6. Subscriptions (Operators)

Operator subscription plans (Basic, Premium, Enterprise) are billed monthly. Plans automatically renew unless cancelled at least 24 hours before the renewal date. Downgrading your plan may result in Listings being hidden if they exceed the new plan's package limit. No refunds are provided for unused portions of a billing period.

7. Reviews

Reviews must be honest, accurate, and based on your personal experience. SafariLists prohibits fake, incentivised, or defamatory reviews. We may remove reviews that violate these standards. Operators may not request removal of legitimate negative reviews.

8. Prohibited Conduct

You may not:

  • Use the Platform for any unlawful purpose.
  • Circumvent the Platform by arranging payments directly to avoid escrow (first inquiry only).
  • Post false, misleading, or fraudulent Listings.
  • Harass, threaten, or abuse other users.
  • Attempt to gain unauthorised access to our systems.
  • Scrape, copy, or redistribute Platform content without permission.

9. Intellectual Property

All Platform content, branding, and software is owned by SafariLists Ltd or its licensors. Operators retain ownership of their Listing content but grant SafariLists a non-exclusive licence to display it on the Platform.

10. Disclaimers & Limitation of Liability

SafariLists is a marketplace platform. We do not operate safaris ourselves and are not responsible for the actions, quality, or safety of individual Operators. We do not guarantee that Listings are accurate or that trips will proceed as described.

To the maximum extent permitted by law, SafariLists' liability to you is limited to the amount of platform fees paid by you in the 12 months preceding the claim.

11. Termination

We reserve the right to suspend or terminate any account that violates these Terms, at our sole discretion. You may delete your account at any time from your account settings. Termination does not affect obligations arising from completed bookings.

12. Governing Law & Disputes

These Terms are governed by the laws of Kenya. Any dispute that cannot be resolved informally will be submitted to arbitration in Nairobi under the Nairobi Centre for International Arbitration rules. Nothing prevents either party from seeking urgent injunctive relief in any competent court.

13. Changes to These Terms

We may update these Terms at any time. We will notify you of material changes by email at least 14 days before they take effect. Continued use of the Platform after the effective date constitutes acceptance of the updated Terms.
